TERMS OF SERVICE

Introduction

  1. These Terms of Service (“Terms”) govern your use of services provided by AROSSCLOUD.INC (“we”, “us”, or “our”). By using our website, creating an account, or purchasing services you accept these Terms. If you do not agree, please do not use our services.
  2. Our website and primary contact: www.arosscloud.com. For support and notices: support@arosscloud.com.

Services Provided

  1. Cloud Hosting (Cloud Servers).
  2. Dedicated Server Rental and Colocation.
  3. Domain Name Registration and Transfer.
  4. SSL Certificates (DV, OV, EV, Wildcard and related services).
  5. Additional managed services as offered on our site.

Accounts and Responsibilities

  1. You must be at least 18 years old or the age of majority in your jurisdiction to use our services.
  2. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  3. You must provide accurate, current and complete information when creating an account and keep it updated.

Payments & Billing

  1. Unless otherwise agreed, services are prepaid. Fees and billing cycles are displayed during purchase.
  2. Failure to pay may result in suspension, restriction or termination of services.
  3. Refunds, if any, are provided according to our Refund Policy and any service-specific terms.

Refund Policy

  1. Cloud Hosting & Server Rental: If service activation fails, you are eligible for a full refund without reason.
  2. SSL Certificates: Refund requests must be made within 7 days of purchase.
  3. Domain Registration: Once successfully registered, no refunds can be provided.
  4. Violations: If services are suspended or terminated due to abuse, infringement, spam, fraud, or resource misuse, no refund will be issued.

Domain Registration & SSL

  1. Domain registrations/transfers are subject to ICANN and registry policies. We do not guarantee availability until registration completes.
  2. SSL certificates are issued by third-party Certificate Authorities (CAs). Issuance times and validation requirements depend on the CA and the type (DV/OV/EV).
  3. We are not responsible for delays, rejections, or additional validation required by third parties.

Acceptable Use & Abuse Policy

  1. Prohibited uses include (but are not limited to): distributing malware, spam, phishing, launching attacks (DDoS), hosting illegal content, or infringing intellectual property.
  2. We reserve the right to suspend, restrict, or terminate services that violate this policy or pose harm to our network, other customers, or third parties.
  3. When suspending services for abuse we will, where feasible, provide notice and an opportunity to remediate; however in cases of immediate threat we may act without prior notice.

Spam & Unsolicited Email

  1. AROSSCLOUD.INC prohibits sending unsolicited bulk email and any activity that violates anti-spam laws (e.g., CAN-SPAM, GDPR-related direct marketing rules where applicable).
  2. If we receive complaints or detect high complaint/abuse rates from an IP or customer account, we may throttle or suspend mail services and require remediation (e.g., removal from mailing lists, implementation of unsubscribe mechanisms, authentication via SPF/DKIM/DMARC).
  3. To dispute a spam suspension, contact support@arosscloud.com with full headers, timestamps, sample messages and steps taken to remediate.

Copyright Complaints & Takedown Procedure

  1. We respect copyright holders. If you believe your copyrighted work has been posted or stored on our services in a way that constitutes infringement, please send a written notice to support@arosscloud.com including:
    1. A physical or electronic signature of the copyright owner or authorized agent;
    2. Identification of the copyrighted work claimed to be infringed;
    3. Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material (URL, account ID, timestamps);
    4. Contact information (address, telephone number, and email) of the complaining party;
    5. A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner or law;
    6. A statement, under penalty of perjury, that the information in the notice is accurate and the complaining party is authorized to act on behalf of the owner.
  2. Upon receiving a valid notice we will act expeditiously to remove or disable access to the allegedly infringing material and notify the account holder. We may suspend or terminate repeat infringers.
  3. Counter-Notification: The account holder may submit a counter-notice if they believe content was wrongly removed. Counter-notice must comply with applicable laws and include a statement consenting to jurisdiction and acceptance of service of process.

Fraud, Scam & Phishing Handling

  1. AROSSCLOUD.INC prohibits hosting or facilitating scams, phishing pages, fraudulent payment schemes, or content that impersonates individuals or organizations to deceive users.
  2. When we receive credible reports of scam or phishing content, we will investigate and may immediately suspend the offending content or account and preserve relevant logs for investigation.
  3. We cooperate with payment processors and law enforcement when fraud is detected. Where required, we will provide account information and logs in response to lawful requests.

Preservation, Law Enforcement Requests & Disclosure

  1. We may preserve and disclose account or usage information when required by law, legal process, or to protect our rights, property or safety, or to prevent harm.
  2. We respond to valid subpoenas, court orders, and other lawful requests from public authorities. We may notify affected users unless prohibited by law.

Limitation of Liability

  1. Services are provided “as is” and “as available.” To the maximum extent permitted by law, AROSSCLOUD.INC is not liable for indirect, incidental, special or consequential damages, including loss of data or business interruption.
  2. Our total liability for any claim related to services is limited to the fees you paid for the affected service in the prior twelve (12) months.

Termination & Suspension

  1. You may cancel or terminate services through your account according to service terms. Data may be retained or deleted per our retention policy.
  2. We may suspend or terminate services for violations of these Terms, abuse, unpaid invoices, or to protect the network and users.

Governing Law

  1. These Terms are governed by the laws of the jurisdiction in which AROSSCLOUD.INC is incorporated or as otherwise specified in individual contracts. Disputes will be resolved in the appropriate courts of that jurisdiction.

  4. We aim to acknowledge receipt of valid reports within 48 hours and to resolve or provide an update as soon as reasonably possible depending on complexity.
